The contract clause is pretty safe in the US. Won't be binding on the second-hand buyer, but can give the original purchaser something to think about. So if you have one and are looking to sell it, you could probably say "I don't want to know what you're going to do with it" and be in the clear.

(There's a way he could be really clever and get more of what he wants out of the agreement, but I ain't saying. He can pay me for my advice after I pass the bar.)

From the interview he must have been born in 1945 so he is or will become 61 this year.

So what exactly is an Ultra-Phonix like? Anything like the ODS or SSS?

I read an interview with Scott Henderson somewhere that said his Dumble was a modified Bandmaster, and he couldn't compare it to anything else because he had never played any of Dumble's other amps.

Well the best I could tell it had two channels but no channel switching. Plug into one or plug in the other. Sounded more like what I would expect an ODS to sound. As far as the SSS, the only one I ever heard was SRV's (on video), that amp reminds me of a Super Reverb and Mega Steroids. Loud, Phat and Clear.

From what I have learned in the past is that the Power amp of the SSS used a driver setup similar to that monster Super Twin (180w) that Fender marketed several years ago. Maybe also similar to the Ampeg SVT. Once again this is all hearsay.

I traded one of my amps for an early 60s vintage 12 string acoustic. It was a 5E3 style with some minor mods and a nice Bluedog speaker. Parts cost me less than the resale value of the guitar, so I guess it was an OK deal, and I can always build another.

However, if I traded one of my amps for a Dumble modified thing, I'd have to make the guy on the other side of the trade swear he'd never let anyone but me look inside, lest someone like Mr. Dumble know my super secret mods to the Deluxe and start building their own versions!

Well, I knew Howard years ago. If he wants to be Alexander now, that's fine with me. There was absolutely nothing wierd or strange about the guy that I could tell. If he got a little paranoid about people ripping off his intellectual property it is no different than Bill Gates and his mafia of lawyers as far as I'm concerned. The guy made the only living he knew how to make from these circuits that we emulate here. Imagine having something valuable of your own and seeing folks rip it off without so much as a whisper of acknowlegement.

He is brilliant. He had health problems in the early 70's that are probably still with him and may well have led him to be something less than a hip, slick and cool socialite. I could be wrong, but I don't think that agreement of his would really hold up in court. No company has a right to tell a customer what they are allowed to do with the purchased product after the point of sale. Ford can't tell me I am legally bound to get my car serviced by their dealership under penalty of suit. If this were the case, all forms of competition are gone. My$0.02

They could if they made you sign the agreement before they sold you the car or amp as the case may be.

Actually Gary, there are a few variants of the SSS out there. Some versions use actual SVT iron and boards in the power amp, some use the Fender Super-Twin style 180-W output stage. There are also some versions using 7247 preamp tubes, and one reputedly using a pentode too. Since most everything HAD ever built was "one-offs", and may were "glopped" it's difficult to clone "his sound" since it is a constant moving target. Here's one of my favorite pics...

As far as ultraphonix, it seems to refer to some (mystical) circuit tweaks he applys to his amps now. Apparently the ODs and other amps can be "upgraded" to ultraphonix specs. What those specs are, or what the circuit changes consist of is as yet unknown.

As he's doing it, he can only get damages for breach of contract out of the original buyer. But he can get damages.

Sometimes people contract away some of their choices. This doesn't void the contract. For example, you can't rescind military enlistment at will. If you have a problem with the consequences of the contract, that's your bad for signing it.

But if he had good legal advice, HAD could go way beyond this and really piss people off.
