stancor a3801 ebay trouble

why is it that when I find an a3801 and try to sell it on ebay as a trainwreck output transformer,somebody flags it for copyright infringment??? Isn't it hard to copyright a hotrodded marshall circuit based on a fender circuit , based n a western electric circuit??

That is stupid. It's them... you know.. "Them"..

Relist it as ORIGINAL TRAINWRECK REPLACEMENT and let's see what happens.
Signatures have a 255 character limit that I could abuse, but I am not Cecil B. DeMille.

No, who is them?? id like to find out. its very hard to copyright anything electronic. If I were to take them to court they wouldn stand a chance.

No, you actually wouldn't stand a chance in court as eBay is just enforcing it's policy to protect a registered trademark, which is found in their "copyright infrigement" policy.

In case you are interested, "them" was actually Ken, I guess you all should blame him.

Observation..... the only people that ever usually complain about these things are folks that don't have a registered patent, copyright, tradement or legacy connection to the original material.

this was intriguing to me, so i looked up their policy. this was the most relevent discussion:

you can scroll down to the 'using brand names appropriately' section. its not a 'trainwreck' transformer so they won't let you call it that. and by calling it a Trainwreck transformer, Stancor might even have a case that you take it down if they really wanted to. it doesn't form/fit exclusively with TW, so that would violate ebay's policy if you said "transformer for trainwreck amp." i THINK what would be acceptable by the policy is to list it as a Stancor A-3801, then in the description note that these were used in some Trainwreck Amplifiers (disclaimer: i'm not knowledgeable enough to know if they were or weren't used in any so maybe be sure of that first).

anyone know if i'm right about that? from their policies it sounds like that could work.

regarding the marshall/fender thing, the circuit wasn't patented and marshall used a different name, look, etc, so that they weren't infringing on the Fender trademark.
